Privacy at Quantum Marketing
Users of our Sites and Services are given the opportunity to provide express and/or implied consent to have certain information, including Personal Information as defined below, used for purposes other than simply using our Site or Services at the point where We ask for this information. This includes providing you the choice whether or not We may share this certain information about you with others.
Users of our Site are made aware if their Personal Information is being collected by or on behalf of any outside parties for marketing purposes. We do this to ensure that our users can make an informed choice as to whether or not they want to share their information with such outside parties.
You can ask Us whether We are keeping information about you; how your information is being used by Us or shared with others; update or delete your information from active promotional databases, or opt-out of the collection and use of your information for promotional purposes by sending an email to email@example.com or by writing Us at Quantum Marketing, 12305 S. New Avenue, Lemont, IL 60439 specifying your request. If you choose to delete your information from active promotional databases or opt-out of the collection and use of your information, you understand that certain and/or all services, including but not limited to, participation in our rewards programs may no longer be available to you. Please state in your correspondence the details of your request. We may require proof of your identity before We provide you with the requested information. We allow you to challenge the data that We hold about you and, where appropriate, you may have the data erased, rectified, amended, or completed. Approved requests will be processed within ten (10) days of the date on which We receive it. We reserve the right to maintain information for fraud prevention, detection and mitigation purposes and to confirm compliance with our Terms of Service.
Notwithstanding the foregoing, We reserve the right to send you certain non-promotional communications to fulfill pending or ongoing services requested by you, relating to the Site and Services, such as service announcements, email related to purchases you have made or information you have submitted, or similar administrative or transactional messages.
QM collects information on our users in various ways, such as, by your voluntary submissions, participation in our promotions, through surveys, contests, sweepstakes, other similar promotions, and through cookie and other tracking technology. The information QM collects is used in a variety of ways, including for internal review, to improve the Site and our Services, to notify you about updates to the Site and our Services; to let you know about products, services, and promotions that you may be interested in, for our marketing purposes, to fulfill and provide services requested by you, including the rewards programs, to identify and address technical issues, to validate and authenticate your login and account registration, to confirm compliance with our Terms of Service, to confirm compliance with the terms of the promotional offer in which you are participating, and for fraud prevention, detection, and mitigation purposes. With your authorization, We may also share the information you provide Us with others.
Personal Information refers to information that tells Us specifically who you are, such as your name, phone number, email, postal address or credit card information, and possibly information relating to certain support or customer service issues. In many cases, We need this information to provide to you services such as certain rewards programs and certain personalized or enhanced service that you may have requested.
We may be required to share Personal Information with others to provide you with certain services, to perform certain services on Our behalf such as fraud prevention, detection and mitigation, to confirm compliance with our Terms of Service, and/or to confirm compliance with the terms of the promotional offer in which you are participating. You never have to provide Us with Personal Information and you can decline this exchange of information on any site on the Internet, not just ours, at any time. However, if you should choose to withhold requested information, We may not be able to provide you with services dependent upon the collection of this information, including but not limited to your participation in our rewards programs.
Other Related Data
Other Related Data refers to information that We collect about you for marketing purposes ('Other Related Data'). For example, We may collect and use information regarding your request and use of promo cards including the date, place, and method of your requests and use. We may also collect Other Related Data through your participation in surveys, contests, sweepstakes, other similar promotions, and through cookie and other tracking technology.
We may be required to share Other Related Data with others to provide you with certain services. You never have to provide Us with Other Related Data and you can decline this exchange of information on any site on the Internet, not just ours, at any time. Except as required to perform the services you have requested, We only collect this information after you have authorized Us to do so. At the direction and on behalf of others, We may also collect Other Related Data for the purpose of onward transfer to others. For example, with your authorization, We may share Other Related Data collected through your voluntary submissions and participation in surveys, contests, sweepstakes, or other similar promotions.
Cookies and Other Tracking Technologies
Tracking technologies may record information such as Internet domain and host names; Internet protocol (IP) addresses; browser software and operating system types; clickstream patterns; and dates and times that our Sites is accessed. An IP address is a number that is automatically assigned to your computer whenever you are surfing the web. Web servers, the computers that 'serve up' webpages, automatically identify your computer by its IP address. We may link the information We record using tracking technologies to Personal Information We collect at the Sites for our own and our marketing partners marketing and advertising purposes. In addition, We reserve the right to use IP addresses and other tracking technologies to identify a visitor when We feel it is necessary to enforce compliance with our Terms of Service, to confirm compliance with the terms of the promotional offer in which you are participating, to protect our Sites, our customers or others, to prevent, detect and/or mitigate fraud, or when We believe in good faith that the law requires it.
The Sites may also use technology called 'tracer tags'. These may also be referred to as 'Pixels', 'Clear GIFs' or 'Web Beacons'. This technology allows Us to understand which pages you visit on the Sites. These tracer tags are used to help Us to optimize and tailor our Sites for you and other users of our Sites.
Pop-up blockers or stoppers prevent extra pop-up windows (usually advertisements) from opening in your browser. Pop-up blocking software often has negative effects on other 'good' software. If you disable Java Script pop-up windows, you may also disable other website functionality that uses Java Script. If you are using a pop-up blocker that allows you to manage a list of 'pop-up friendly' sites, please refer to your Help files and add the URL of our Sites to your approved list to ensure maximum functionality at the Sites.
Disclosures and Transfers of Information
We do not disclose Personal Information or Other Related Data (collectively, 'Relevant User Information') to third parties, except when one or more of the following conditions is true:
- We have the individual's permission to make the disclosure;
- The disclosure is permitted by relevant law;
- The disclosure is reasonably related to the sale or other disposition of all or part of our business or assets;
- The Relevant User Information to be disclosed is publicly available;
- The party to whom the disclosure is made controls, is controlled by, or is under common control with QM;
- The disclosure is reasonably necessary for the establishment or maintenance of legal claims;
- The disclosure is to persons or entities for whom We are providing services, provided the disclosure is consistent with the purpose for which the personal information was obtained; or
- The disclosure is necessary to identify and address technical issues, to validate and authenticate your login and account registration, to confirm compliance with our Terms of Service, to confirm compliance with the terms of the promotional offer in which you are participating, and/or for fraud prevention, detection, and mitigation purposes.
Prior to sharing of your Relevant User Information with others, agreements are made between QM and such outside parties to whom We are transferring data. Under these agreements, outside parties are required to provide and follow privacy standards that comply with relevant privacy laws. If QM becomes aware that any such outside party is improperly using or disclosing Relevant User Information, it will notify that outside party and take commercially reasonable steps to cease such use or disclosure.
For certain promotions and services, We may make Personal Information that you provide Us available to one or more financial institutions, in order to fulfill and carry out the purchase, reward, provision, issuance, or redemption of reward certificates or other similar credits requested by you. By providing Us your Personal Information for these purposes, you authorize Us to exchange your Personal Information with such financial institutions. If you do not want your Personal Information shared with such financial institutions, you will not be able to participate in our rewards programs or other similar services.
- Quantum Marketing and Promo Card Promotions: If you choose to participate in any thepromocard.com promotions, any Personal Information you provide is collected on behalf of the partner(s) in order to fulfill and carry out the redemption of your rewards and is subject to our partner(s)' privacy policies. When participating in any www.thepromocard.com Program, you agree that any Personal Information you provide to Us will be transferred to our partners and that you are responsible for reading and understanding their privacy policies.
As a Service to Others
Relevant User Information
Our Service Providers
We may sometimes use other businesses to perform certain services for us, such as maintaining our Sites, mailing lists, processing orders and delivering products and services, sending postal mail, processing claims for lost or stolen certificates or cards, providing marketing assistance, and data analysis, and preventing, detecting and mitigating fraud. ('Service Providers'). We may provide Relevant User Information to Service Providers when that information is necessary for them to complete a requested transaction or otherwise perform their duties. QM will take reasonable steps to ensure that these Service Providers are obligated to reasonably protect Relevant User Information on QM's behalf.
As QM develops, We may buy other businesses or their assets or sell our business assets. Relevant User Information is generally one of the business assets involved in such transactions. Thus, in the event that QM or all of its assets are acquired, Relevant User Information may be one of the transferred assets.
Protection of QM and Others
QM fully cooperates with law enforcement agencies in identifying those who use our services for illegal activities, and may in its sole discretion disclose Personal Information and Relevant User Information or other information to satisfy any law, regulation, subpoena, or government request or in connection with litigation. QM reserves the right to release Relevant User Information or other information about users who We believe are engaged in illegal activities, fraud, or are otherwise in violation of our Terms of Service, and/or the terms of the promotional offer in which you are participating, even without further consent or a subpoena, warrant or court order, if We believe in our sole discretion that such disclosure is necessary or appropriate to operate the Sites, to prevent, detect or mitigate fraud, or to protect the rights or property of QM, its affiliates, or any of their officers, directors, or employees, agents, third party content providers, suppliers, sponsors, or licensors. QM also reserves the right to report to law enforcement agencies any activities We reasonably believe in our sole discretion to be unlawful.
Data Security, Integrity, and Access
QM will collect, use, and maintain Relevant User Information only in ways that are compatible with the purposes for which it was collected or authorized by the individual. QM will take reasonable steps to ensure that Relevant User Information is relevant to its intended use, accurate, complete and current. We may also use security safeguards and fraud prevention, detection, and mitigation measures, which may require the retention of information, including but not limited to email addresses and IP addresses.
The Relevant User Information you provide and We collect is stored within databases that We control directly or through our Service Providers. As We deem appropriate, We use security measures consistent with industry standards, such as firewalls and encryption technology, to protect your information. However, since no security system is impenetrable, We cannot guarantee the security of our databases, nor can We guarantee that information you supply will not be intercepted while being transmitted to Us over the Internet.
If you create a Site Account, you may be asked to choose a password for your account, in which case your online account information shall be protected by your password. We recommend that you do not disclose your password to any other person. You are responsible for maintaining the confidentiality of your password and Site Account, and are fully responsible for all activities that occur under your password or Site Account. You can access and update information in your account profile at any time by logging in to the website with your login name and password. Once you have logged in, you can update your certain information such as your name, e-mail, password, and/or change your address.
Third Party Websites and Links
Please note that you may have cookies placed on your computer by third party websites that refer you to the Sites. Although We do not share your Relevant User Information with these third party websites unless you have authorized Us to do so, they may be able to link certain non-personally identifiable information We transfer to them with Relevant User Information they previously collected from you. Please review the privacy policies of each website you visit to better understand their privacy practices. In addition, QM would like to inform you that anytime you click on links (including advertising banners), which take you to third party websites, you will be subject to the third parties' privacy policies. While We support the protection of our customer's privacy on the Internet, QM expressly disclaims any and all liability for the actions of third parties, including but without limitation to actions relating to the use and/or disclosure of Relevant User Information by third parties.
QM does not intend the Sites and Services to be used by individuals under the age of 18 without the supervision of a parent or guardian 18 years of age or older. QM relies upon parents or guardians 18 years of age or older to determine if the Sites and Services are appropriate for the viewing, access, or participation by such individuals under the age of 18. If an individual under the age of 18 uses the Sites and Services, such individual may only use the Sites and Services under the supervision of a parent or guardian 18 years of age or older.
We do not seek or knowingly collect any Relevant User Information about children under 13 years of age. If We become aware that We have unknowingly collected Relevant User Information from a child under the age of 13, We will make commercially reasonable efforts to delete such information from our database.
Governing Law; Visitors Residing Outside the United States
Notice to California Residents
California Civil Code Section 1798.83 permits California residents to request information regarding the disclosure of their personal information to third parties for third parties' direct marketing purposes.
